O n\u00famero de postos gerados representa 15,4% do total de vagas criadas no per\u00edodo no pa\u00eds (660.390) \u2013 ou seja, quase uma em cada seis vagas criadas foi para a modalidade de contrato intermitente.<\/p>\n<\/div>\n<div class=\"wall protected-content\">\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"56\" data-block-id=\"2\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Ainda assim, at\u00e9 agora as contrata\u00e7\u00f5es na modalidade est\u00e3o bem abaixo da expectativa divulgada pelo governo na \u00e9poca da cria\u00e7\u00e3o da modalidade, de criar 2 milh\u00f5es de empregos em 3 anos, ou 55 mil vagas por m\u00eas. Al\u00e9m disso, a presta\u00e7\u00e3o de servi\u00e7os espor\u00e1dica deve ser registrada em carteira e h\u00e1 direitos trabalhistas previstos como f\u00e9rias e 13\u00ba proporcionais e data-track-links=\"\">As empresas, no entanto, apesar de colocarem v\u00e1rios an\u00fancios de vagas intermitentes em sites de emprego, preferem n\u00e3o falar sobre o assunto. A cautela vem do fato de a forma de contrata\u00e7\u00e3o ainda gerar d\u00favidas e estar sendo contestada na Justi\u00e7a. No Supremo Tribunal Federal (STF), por exemplo,\u00a0<a href=\"https:\/\/g1.globo.com\/economia\/concursos-e-emprego\/noticia\/2019\/06\/15\/nova-lei-trabalhista-e-questionada-em-14-acoes-no-stf.ghtml\">h\u00e1 cinco a\u00e7\u00f5es diretas de inconstitucionalidade (ADIs) contestando a modalidade<\/a>. Uma delas \u00e9 da Confedera\u00e7\u00e3o Nacional dos Trabalhadores na Ind\u00fastria (CNTI), que representa 5 milh\u00f5es de pessoas.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"49\" data-block-id=\"10\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Na a\u00e7\u00e3o, a entidade alega que n\u00e3o h\u00e1 garantia de que o intermitente receber\u00e1 o sal\u00e1rio m\u00ednimo nem o equivalente ao recebido pelo funcion\u00e1rio da empresa. Por isso, a contrata\u00e7\u00e3o seria uma forma de empregar m\u00e3o de obra por um custo menor para realizar o mesmo trabalho dos demais.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"64\" data-block-id=\"11\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">A CNTI elenca ainda a necessidade de o trabalhador pagar a diferen\u00e7a ao INSS em caso de receber menos de um sal\u00e1rio m\u00ednimo &#8211; o equivalente a 8% entre o sal\u00e1rio recebido e o sal\u00e1rio m\u00ednimo. \u201cCaso o trabalhador n\u00e3o complemente a contribui\u00e7\u00e3o, o m\u00eas trabalhado n\u00e3o entra no c\u00e1lculo para aposentadoria e ele tamb\u00e9m n\u00e3o ter\u00e1 direito a benef\u00edcios previdenci\u00e1rios\u201d, afirma na a\u00e7\u00e3o.<\/p>\n<\/div>\n<div class=\"mc-column content-text active-extra-styles \" data-block-type=\"unstyled\" data-block-weight=\"72\" data-block-id=\"12\">\n<p class=\"content-text__container \" data-track-category=\"Link no Texto\" data-track-links=\"\">Por outro lado, o Tribunal Superior do Trabalho (TST) deu raz\u00e3o ao Magazine Lu\u00edza ap\u00f3s o Tribunal Regional do Trabalho de Minas Gerais considerar nulo o contrato intermitente de um assistente de loja da empresa.
